RIGHT OF WITHDRAWAL

The CUSTOMER shall have a period of 30 working days from the date of receipt of the product to return it. In any case the shipping costs will be borne by the CUSTOMER and the product must be returned in its original packaging and in perfect condition.

Size Change: What happens if I made a mistake with the size?

If you want to change the size of a product, you have a period of 30 days from the delivery of the order. To carry out this process quickly and effectively, you must use our returns portal at the following link: Nox Sport - Returns Portal.

Steps to follow:

2. Follow the steps indicated on the platform:

   • Proceed by following the instructions provided on the portal to complete the process.
3. Methods of return
1. Drop-off point: You must drop off the package at one of our pick-up points located in your area.
2. Home Pickup: We will pick up your package at your home address within the next 24-48 working hours.
4. Reshipment of the Requested Size:
• Once we have received and reviewed the condition of the returned product, we will proceed with the reshipment of the requested size.

It is important to note that the direct cost associated with the return of the goods will be the responsibility of the CUSTOMER.

APPLICABLE WARRANTIES

All products offered through our website are completely original, unless expressly stated otherwise in their description.

In accordance with current regulations on warranties of consumer goods, our products are guaranteed for 2 years from the date of purchase invoice, although during the first months the defect that the product may present is presumed to be original factory, unless proven otherwise, the customer must prove that it is also a defect originating from the factory if it occurs from the fourth month and before the two years.

To make use of the warranty, it will be essential to present the invoice or the purchase receipt.

If within the warranty period the product has defects or failures that the customer suspects may be of manufacturing origin, you can contact our customer service through the "Shipping and Returns" section of our website. Our team will manage the evaluation process and, if necessary, repair, replacement, price reduction or termination of the contract, at no cost to the customer.

Important: In case the purchase of a NOX item has not been made directly in our official online store noxsport.com, the processing of the warranty must be managed exclusively through the point of sale or store where the purchase was made.

Once the item has been analyzed by the technical service, there are three possible situations:

- That the technical service fixes the product and it is returned to the customer.

- That the technical service changes the item for a new one. In this case, the same item willALWAYS be returned, and it is not possible to exchange it for a different one (except for lack of stock).

- That the technical service determines that the product has no manufacturing fault and that the change or repair does not proceed. In this case, the original product will be returned to the customer.

(Arts. 114 and following of the Royal Legislative Decree 1/2007, of November 16, which approves the Revised Text of the General Law for the defense of consumers and CUSTOMERS and other complementary laws - BOE No. 287, of November 30, 2007).

Applicable law and jurisdiction

These conditions shall be governed or interpreted in accordance with Spanish law in that which is not expressly established. The provider and the CUSTOMER agree to submit any dispute that may arise from the provision of products or services covered by these Conditions, to the Courts and Tribunals of Barcelona.

In the event that the CUSTOMER is domiciled outside Spain, the provider and the CUSTOMER expressly waive any other forum, submitting to the Courts and Tribunals that are competent and legally determined by the laws applicable to this contract.

By placing your order, you agree to these Terms and Conditions and the Terms of Service below.

1. Physical gifts will be available while supplies last, but in no event will the order be shipped without a corresponding gift or replacement thereof, if so indicated on the order.
2. We reserve the right to exchange the gift items for others of equal or greater value.
3. Gifts are not redeemable for cash, nor are exchanges or returns allowed without prior approval.
4. Returns of gift items must be approved in writing in advance at the Customer Service Center and will be accepted or not, depending on the availability of items.
5. The shipping costs for the exchange of gift items, previously approved, shall be borne by the customer both in the section from their home to our facilities and in the section of replacement of our facilities to the customer's home.
6. In the case of placing an order that corresponds to a gift and not have stock of the initial order at that time, you will be offered compensation for the inconvenience caused by another article of equal or better features that may correspond to gift item or not.
7. The resolution of any dispute that may arise from the relationship will be resolved in accordance with Spanish law and will be subject to the Courts and Tribunals that are competent and legally determined by the laws applicable to this contract.

All the information relative to the products and/or services offered by JJ Ballvé Sports S.L, will be published through the Web Site www.noxsport.com, indicating the following information with respect to each one of them:

At any time, new Products may be added to those included in the Web Site, it being understood, unless otherwise provided, that such new Products shall be governed by the provisions of the General Conditions in force at that time.

In the event that at the time of purchase there is no stock of any of the products requested, NOX will inform the Customer of this situation, indicating the possibility of waiting for the existence of stock of the product, cancel the purchase, implying the corresponding refund of the economic amounts paid, or if necessary, supply a product of similar or superior characteristics (with the same or even higher qualities), subject to approval by the customer.

The availability of products and stock during the purchase process, is mentioned as an indication and therefore will not have a contractual nature, since it may happen that purchases of the same item are occurring at the same time, the product is unavailable and there is a breakage of stock.

Being e-commerce, the stock is updated online, so it could happen, eventually, that during the purchase process the stock runs out.

In the event that there is a breakage of stock of the product, from www.noxsport.com will contact the customer to inform him of the situation, indicating, on the one hand, the approximate delivery date on which the order will be supplied, without price increase, and on the other hand, the customer will be offered the option to send a product of similar or superior characteristics to that initially ordered, the customer may exercise their rights of withdrawal and resolution in the same terms as if it were the initially required good.
